1. Introduction and Acceptance

These Terms of Service ("Terms") govern your use of RentSure, a property verification and tenant support platform operated by app-factory.dev Limited ("we", "us", "our").

By accessing or using RentSure, you agree to be bound by these Terms. If you do not agree, please do not use our services.

2. Description of Service

RentSure provides:

Property Verification Reports: Aggregated public data about UK rental properties including EPC ratings, flood risk, crime statistics, council tax, and broadband availability
Tenancy Documentation Tools: Features to document move-in condition, maintenance issues, and communications
Dispute Support: Tools and guidance for deposit disputes and claims

3. Important Disclaimers

3.1 Information Accuracy:

Our reports compile publicly available data from official sources. While we strive for accuracy, we cannot guarantee the data is complete, current, or error-free. Official records may contain errors or be out of date. You should verify critical information independently before making decisions.

3.2 Not Legal Advice:

RentSure provides information and tools to help tenants. We are not a law firm and do not provide legal advice. Our dispute letter templates and guidance are informational only. For specific legal matters, consult a qualified solicitor or Citizens Advice.

3.3 No Guarantee of Outcomes:

We cannot guarantee the outcome of any dispute, claim, or negotiation. Our tools improve your chances but results depend on individual circumstances.

4. User Accounts

You are responsible for:

Providing accurate registration information
Maintaining the security of your account credentials
All activity that occurs under your account
Notifying us immediately of any unauthorized access

5. Acceptable Use

You agree not to:

Use RentSure for any unlawful purpose
Upload false or misleading information
Attempt to access other users' accounts or data
Use automated systems to scrape or extract data
Resell or redistribute our reports without permission
Use our platform to harass landlords or agents

6. Payments and Refunds

6.1 Pricing:

Property verification reports are priced as displayed at checkout. Prices may vary based on report type and are subject to change.

6.2 Payment Processing:

Payments are processed securely via Stripe. We do not store your full card details.

6.3 Refunds:

Due to the immediate delivery of digital reports, refunds are generally not available once a report has been generated. If you believe there is an error in your report, contact us within 14 days and we will investigate.

7. Intellectual Property

7.1 Our Content:

The RentSure platform, branding, and original content are owned by app-factory.dev Limited. You may not copy, modify, or distribute our platform without permission.

7.2 Your Content:

You retain ownership of photos, documents, and other content you upload. You grant us a licence to store and display this content to provide our services.

7.3 Reports:

Property reports you purchase are for your personal use. You may share them with landlords, agents, or dispute resolution services as needed for your tenancy.

8. Limitation of Liability

8.1 Service Limitations:

RentSure is provided "as is" without warranties of any kind, express or implied. We do not warrant that the service will be uninterrupted or error-free.

8.2 Liability Cap:

To the maximum extent permitted by law, our total liability for any claims arising from these Terms or your use of RentSure shall not exceed the fees you paid to us in the 12 months preceding the claim.

8.3 Excluded Damages:

We are not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or other intangible losses.

8.4 Exceptions:

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or other liability that cannot be excluded by law.

9. Termination

You may close your account at any time through the platform or by contacting us.

We may suspend or terminate your account if you violate these Terms or for other legitimate business reasons with reasonable notice.

Upon termination, you can export your data for 30 days. Property reports you have purchased remain accessible.

10. Dispute Resolution

10.1 Governing Law:

These Terms are governed by the laws of England and Wales.

10.2 Jurisdiction:

Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

10.3 Informal Resolution:

We encourage resolving disputes informally first. Contact us at hello@app-factory.dev and we'll try to sort things out.

11. Consumer Rights

If you are a consumer in the UK, you have statutory rights under consumer protection laws that cannot be excluded. These Terms do not affect those rights.

For information about your statutory rights, contact your local Trading Standards office or Citizens Advice Bureau.

12. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by email or through the platform. Continued use after changes constitutes acceptance.

13. General Provisions

Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and us.

Severability: If any provision is found unenforceable, the remainder of these Terms remains in effect.

No Waiver: Our failure to enforce any provision does not waive our right to enforce it later.
